Job purpose
We are seeking a head of Commercial Legal to join our Legal team. This position will provide legal advice and support to our U.S. and ex-U.S Commercial, Medical Affairs, and other teams interacting with healthcare providers, patient groups, payers, government agencies and their employees, and other stakeholders in the healthcare ecosystem. This is an in-office role.
Responsibilities
- Strategically partner for a fast-paced and growing biotechnology organization, with specific responsibility for delivering timely legal advice to the company’s Commercial, Medical Affairs, and other departments interacting with health care providers, patient groups, payers, government agencies and their employees, pharmacies, GPOs and other stakeholders in the healthcare ecosystem.
- These responsibilities will include advising on:
- Promotional efforts
- Medical Affairs activities
- External events arranged or attended by client groups, such as conferences, seminars, etc.
- Compliance with government price reporting requirements, government pricing negotiations and health technology assessment procedures
- Patient support and reimbursement programs
- Conduct of advisory boards and speaker programs
- Advising on patient advocacy and patient organizations
- Competition related issues
- Review scientific publications, press releases, scripts, slide decks and other materials that reference the company’s products or product candidates
- Advise commercial leaders and members of the global commercial leadership team
- Provide mentorship and supervise a legal and compliance team based in Zug, Switzerland
- Manage contracting for managed care, commercial distribution, commercial vendors, and other contracts for client groups
- Provide advice and recommendations for pricing and reimbursement arrangements, including US government price reporting
- Monitor and advise on relevant legal developments, trends, and risks affecting the business and the industry
- Build and improve processes and systems to enhance the efficiency and effectiveness of the commercial legal function
- Work closely and collaboratively with the company’s Chief Compliance Officer and the compliance organization
- Some travel will be required for this role
Qualifications
- JD degree with 10+ years of experience as in-house counsel or associate at a major law firm with a background in biotechnology, pharma or healthcare related matters. A combination of both in-house and law firm experience is a plus
- Admitted to at least one state bar
- Deep experience advising on relevant heath care laws and regulations (e.g., FDCA, Anti-kickback, antitrust laws, and state consumer protection laws)
- The successful candidate will demonstrate a strong commitment to ethics and integrity
- Detailed-oriented with a high level of intellectual, professional, and interpersonal agility and flexibility
- Excellent communication, influencing, and client service skills
- Well-organized and hardworking, with the ability to manage numerous projects simultaneously under deadline pressure
- Excellent analytical skills, with a strong ability to draft and review legal documents, analyze legal advice, and apply legal advice to business needs
- Ability to form strong working relationships with all levels of management, employees, and external stakeholders while maintaining firm adherence to proper legal standards
- Team-oriented, sound judgment, self-motivation, and willingness to take initiative
- Location is in the Philadelphia/Radnor area
